Below terms of service and support related is an agreement between Digimiles India Pvt. Ltd (www.digimiles.in or Digimiles) and individual/company/public limited/govt. sector or any human who is currently accessing this website or already accessed and used our trial version or became a business customer with us by availing the services.
Digmiles doesn’t offer a guarantee or warranty as to the accuracy, timeliness, performance, or sustainability of the information offered on this website for any specific purpose. You are solely responsible for accessing information or availing of the service under the laws of the jurisdiction.
The terms you may enter into with Digimiles in connection with the services shall constitute the whole agreement between you and Digimiles concerning the offerings. Any court of India shall have jurisdiction for all purposes in connection with any action that arises from or relates to these terms, and you hereby irrevocably waive any objection to such exclusive jurisdiction; provided, however, that Digimiles may seek to enforce any judgment in its favor in any court of competent jurisdiction.
1. Registration process
The user after completing the registration formality shall get the credentials to access our service (API/dashboard). For customers, the registration formalities include
- Providing the undertaking letter on the company letter head with authorized signatory, stamp and any Govt. Id proof.
- Completing the DLT registration procedure.
- Accepting the Digimiles, TRAI and DLT operators’ terms of service and privacy policy.
The user(customer) hereby agrees that
- The contact and KYC information provided is true.
- He/she is of legal age to use our SMS service and is not the individual/brand who’s barred from using telecom services under the TRAI rules.
- To update their contact data (email/mobile) if changed to avoid miscommunications.
- To receive login credentials via email only upon registration formality and user is the sole responsible for the usage and conduct of the given service.
2. Service usage
The customer hereby agrees that
- Digimiles play a neutral role in terms of service offering as TRAI and telecom operators owns the major part of the infrastructure. It means Digimiles make no guarantee regarding the SMS delivery time or network availability.
- The customer sends only true and authentic information to its clients that doesn’t involve fraud, threat, misled, and adult content.
- To not to send information which is against Indian laws, or violating third party rights.
- To maintain dignity and patience if in case the service go down for any time period that is out of Digimiles limits and not to cause harm to Digimiles property or its employees.
- If any link(s) within Digimiles website that let the user leave the website such as payment gateway, TRAI regulations, DLT operator website, etc are not under the control of Digimiles and the user is required to read their terms of service and not to blame Digimiles further.
- Digimiles never offer mobile database to any users.
- Digimiles has the right to suspend or terminate user’s service if the user is misusing or misused the service.
3. SMS credits
In the case of a regular English text message, 1 SMS credit will be counted as 160 characters and that includes spaces and characters. Digimiles advises you not to send more than 800 characters as the receiver would receive the SMS as split as per the handset model.
In the case of regional text messages, 1 SMS credit will be counted as 70 characters and Digimiles take no responsibility for the SMS delivery as it depends on the handset model.
4. Pricing and payment related
- The user agrees that Digimiles has the right to modify the pricing mentioned on it’s website if telecom operators or TRAI brings a price update in future. If such happens, Digimiles will notify to the user via email or blog.
- 18% GST is mandatory and the tax invoice will be given to the user post payment.
- The user hereby agrees to pay the full amount in advance through online (Bank Transfer/Cash Deposit/Cheque) and the service will be delivered once cheque gets cleared or money falls into the account of Digimiles in case of NEFT/Cash deposit.
- In case of payment failure, Digimiles takes no responsibility and the user will be advised to contact their respective bank with the reference ID.
- Strictly no payment refund will be encouraged.
5. DND complaint
- The user agree to maintain their opt-in form (digital consent) which is not older than 6 months and share with us to close the DND complaint if required.
- The user must inform their subscribers about the opt-in and opt-out procedure via digital channel.
6. Sender ID (Header)
- In case of promotional SMS, a 6 digit numeric ID will be allotted to the user.
- In case of service SMS, a 6-alphabetic sender ID can be given by Digimiles. However, the user must get that approved from DLT portal first.
- The sender ID must not be generic. It must represent the user’s brand name in short.
- Sender ID approval time and availability are subjected to telecom operators’ availability.
7. Technical support
- Digimiles will not offer API integration service but you can access to it’s API documentation guide.
- General queries related to API and service will be offered on regular working hours. If the user find any error or difficulty in API integration part, the user is required to send the complete issue details with supporting screenshots to support@digimiles.in email ID to avail assistance.
8. USE of your data
Digimiles may use your information for communication, advertising, optimization and with the governing agencies with whom we have contractual relationships. By using our service and providing your data, you agree to us doing so in accordance with this term of privacy and applicable data protection laws.
Digimiles has right to modify the terms mentioned on this page with/without notice to the users. So the users are advised to visit this page regularly.
